With the increasing importance of intellectual property protection, the establishment of a patent invalidation system constitutes a crucial support for strengthening the full-chain protection of intellectual property rights and advancing the high-quality development of intellectual property protection efforts. Currently, various countries worldwide have established different types of patent invalidation systems.
China's Patent Reexamination and Invalidation Department of the China National Intellectual Property Administration (CNIPA) was established on April 5, 1985. As an internal agency of the CNIPA Patent Office, it undertakes the function of adjudicating requests for patent invalidation.
From the date when the patent right is announced by the patent administration department under the State Council, any entity or individual that considers the grant of the patent right not to comply with the relevant provisions of the "Patent Law" may request the declaration of invalidation of said patent right. After the Patent Reexamination and Invalidation Department issues a decision to invalidate the patent right and it becomes effective, it is registered and announced by the CNIPA, known as the patent invalidation decision announcement.
CnOpenData aggregates and organizes the aforementioned data to form China's Patent Invalidation Data-Source A and Source B. Source A comprehensively summarizes detailed information according to patent types. The information table displays invalidation decision publication information including decision number, patent number, invention name, patentee, invalidation requester, and dispatch date. The details table provides a more exhaustive introduction to the basic information during the application and authorization stages of invalidated patents. Source B primarily presents detailed data on the legal status of patent invalidation or partial invalidation, containing fields such as Patent ID, Transaction Type ID, Transaction Type (Chinese), Transaction Type Details, Transaction Data Announcement Date, Examination Conclusion, Invalidation Decision Date, and Invalidation Decision Number, facilitating scholars in conducting meticulous research on patent issues.
