  Credit is becoming one of the most crucial components in socioeconomic development. However, debtors who refuse to fulfill court judgments (commonly referred to as "deadbeat debtors") remain prevalent in China, giving rise to the concept of "dishonest persons subject to enforcement." On July 16, 2013, the Supreme People's Court issued the Provisions on the Publication of Information on Dishonest Persons Subject to Enforcement, which took effect on October 1, 2013. These provisions aim to compel dishonest persons subject to enforcement to fulfill their obligations promptly and promote the construction of a social credit system.

  It is important to distinguish between two related but distinct concepts:

  • Person Subject to Enforcement refers to a party who refuses to comply with court judgments or arbitration awards after the statutory appeal period has expired or a final judgment has been rendered. When a defendant fails to fulfill court-ordered compensation within the legally prescribed time frame after losing a civil lawsuit, they become the subject of court-enforced execution.
  • Dishonest Person Subject to Enforcement refers to a person subject to enforcement who has the capacity to fulfill their obligations but refuses to do so, and meets any of the following criteria:

(1) Obstructing or resisting enforcement through fabricated evidence, violence, threats, etc.;
(2) Evading enforcement through false litigation, fraudulent arbitration, or concealment/transfer of assets;
(3) Violating asset reporting requirements;
(4) Breaching restrictions on high-consumption activities;
(5) Refusing to fulfill settlement agreements without justifiable cause;
(6) Other circumstances demonstrating willful refusal to fulfill legally effective obligations.

  To address these issues, CnOpenData has compiled a comprehensive list of dishonest enterprises, including basic information fields such as enterprise name(企业名称), disclosure date of dishonesty(失信公布日期), case filing date(立案日期), operational status(经营状态), and organization code(组织结构代码).
