  Commercial franchising refers to business activities where an enterprise (referred to as the franchisor) possessing operational resources such as registered trademarks, corporate logos, patents, and proprietary technologies licenses these resources to other operators (referred to as franchisees) through contractual agreements. Franchisees operate under a unified business model as stipulated in the contract and pay franchise fees to the franchisor. The core elements of commercial franchising include the licensing of intellectual property rights, the franchisor's established operational model and continuous guidance capabilities, and franchisees' operation under a standardized framework with fee obligations.

  The application requirements for commercial franchising are as follows:

  • Entities other than enterprises (e.g., individuals or non-corporate units) are prohibited from acting as franchisors.
  • The franchisor must possess operational resources such as registered trademarks, corporate logos, patents, or proprietary technologies.
  • The franchisor must demonstrate a mature operational model and the ability to provide ongoing operational guidance, technical support, and training to franchisees.
  • The franchisor must operate at least two directly owned outlets for over one year.
  • The franchisor must file with the competent commerce authority within 15 days of signing the first franchise agreement.

  To support related research, CnOpenData has released commercial franchise enterprise filing data, comprising five tables: Basic Information of Franchise Enterprises, Operational Resource Information, Domestic Franchisee Outlets, Filing Revocation Announcements, and Business Registration Details. These tables include fields such as Franchisor Name (特许人名称), Filing Number (备案号), Announcement Date (公告时间), Franchisee Name (加盟店名称), and Filing Revocation Status (撤销备案).
